LIABILITY WAIVER AND RELEASE AGREEMENT

KIDS CIRCUS ARTS places the highest priority on the safety and well-being of all participants. While the Company endeavors to minimize risks through established safety protocols and supervision, the undersigned parent or legal guardian acknowledges that recreational activities, including aerial acrobatics and gymnastics, inherently involve a risk of injury.

1. Assumption of Risk

By enrolling, paying for, or permitting my minor child (“Participant”) and any accompanying guests to attend classes, programs, camps, lessons, meets, birthday parties, open gyms, field trips, or any other activities conducted or sponsored by the Company (collectively, “Activities”), I acknowledge and accept the inherent risks associated with participation in such Activities. I voluntarily assume full responsibility for all risks of injury, loss, or damage sustained by the Participant, myself, my family, and any accompanying guests arising out of or in connection with participation in the Activities.

2. Emergency Medical Authorization

I authorize the Company and/or any appropriate medical facility to administer emergency measures, including but not limited to first aid, disaster evacuation, or other medical treatment, as deemed necessary for the care and protection of the Participant and any accompanying guests while under the supervision of the Company. In the event of an emergency, I understand that transportation to a medical facility may be arranged by local emergency services, and that all associated costs shall be borne solely by me. I further acknowledge that in certain circumstances, Company staff may be required to contact emergency services prior to reaching a parent, guardian, physician, or other representative.

3. Release and Indemnification

I, as parent or legal guardian of the Participant, hereby release, discharge, and agree to indemnify and hold harmless the Company, its owners, employees, agents, contractors, and volunteers from any and all claims, demands, liabilities, damages, losses, or expenses, whether known or unknown, arising out of or in connection with participation in the Activities, including but not limited to claims for negligence, personal injury, property damage, invasion of privacy, or wrongful death.

4. Authority and Binding Effect

By signing below, I confirm that I am the parent or legal guardian of the Participant and have full authority to execute this Agreement on their behalf. This Waiver and Release shall be binding upon myself, the Participant, our family members, any accompanying guests, and our respective heirs, executors, administrators, successors, and assigns.

CANCELLATION POLICY

This Cancellation Policy (“Policy”) governs all bookings for group classes and private classes offered by Kids Circus Arts (the “Company”). By enrolling in any class, each student (“Participant”) acknowledges and agrees to be bound by the terms set forth herein.

1. Group Classes

1.1 Standard Cancellation: Participants must provide not less than three (3) days’ prior written notice to cancel a group class booking.

1.2 Illness Cancellation: Participants may cancel a group class booking due to illness by providing not less than three (3) hours’ prior notice.

1.3 Late Cancellation: Any cancellation made with less than the required period shall be deemed a late cancellation and shall be charged in full.

1.4 Class Expiry Policy: For regular term enrollments, any unused classes may be carried forward and redeemed in the subsequent term and/or camp, subject to a maximum extension of two (2) additional months. Term breaks shall not be counted toward the extension period.

2. Private Classes

2.1 Advance Notice: Participants must provide not less than twenty-four (24) hours’ prior notice to cancel or reschedule a private class booking.

2.2 Late Cancellation: Any cancellation made within twenty-four (24) hours of the scheduled class start time shall be deemed a late cancellation. In such cases, the Participant shall be charged in full, with no credit or refund issued.

3. No-Show Policy

3.1 A “No-Show” occurs when a Participant fails to attend a scheduled class without providing notice in accordance with the above Section 1 or Section 2. No-Shows shall be charged in full, with no reschedule or refund permitted.

4. Class Cancellation by the Company

4.1 The Company reserves the right to cancel any group class with only one (1) Participant enrolled, provided that such cancellation is made not less than two (2) days prior to the scheduled start time.

4.2 The Company shall notify the affected Participant of such cancellation via WhatsApp and/or email promptly upon decision.

4.3 Credits for the cancelled class shall be returned to the Participant’s account.

5. Bad Weather Arrangements

5.1 T3 / Yellow / Red Rainstorm Signal: Classes shall proceed as scheduled.

5.2 T8 / Black Rainstorm Signal: Classes shall be cancelled if the signal remains in effect two (2) hours prior to the scheduled class start time.

• Pay-As-You-Go Members: No charge shall apply.
• Course Members: The cancelled class shall be rescheduled or replaced at no additional cost.
